Starting on January 1, 2023, employers with at least 15 workers will have to include pay ranges in job postings.
In addition, employees will also be able to ask for the pay range for their own position. Finally, employers must maintain records including the wage rate history and job title for each employee for 3 years beyond their employment, and data pertaining to race, ethnicity and sex, and the records can be inspected by the labor commissioner and penalties can be assessed for failure to comply. If companies aren’t adding ranges, people
can sue or file a complaint with the Labor Commissioner’s Office, which can issue a penalty of $100 to $10,000 per violation.

Also, if an employer has 100 or more employees, a pay data report needs to be submitted to the California Civil Rights Dept. (CRD formerly known as DFEH) by May 10, 2023. (Gov Code § 12999). Please see the article below for more details.

2023년 1월 1일부터 노동법 423.3조항에 따라 직원이 15명 이상인 고용주는 채용 공고에 급여 범위를 포함해야 합니다. 또한 지원자 또는 현재 직원이 요청하는 경우, 고용주는 해당 직위에 대한 급여 범위 (예상 급여 또는 시급 범위)를 제공해야 합니다. 마지막으로 고용주는 고용 이후 3년 동안 각 직원의 임금 내역 및 직책과 인종, 민족 및 성별에 관한 정보를 포함하는 기록을 유지해야 하며, 해당 기록은 노동청에서 열람할 수 있으며 위반 시 처벌을 받을 수 있습니다. 금지 명령 구제 (injunctive relief) 또는 법원의 판단에 따라 위반에 대한 민사 소송도 가능할 수 있습니다.

또한 고용주의 직원이 100명 이상인 경우 급여 데이터 보고서를 2023년 5월 10일까지 California Civil Rights Dept. (CRD, 이전 DFEH 부)에 제출해야 합니다. (Gov Code § 12999).
