<코로나 바이러스- PPP 지원금 전액 면제 조건 변경 안내>
6/3 상원이 하원에서 통과시킨 Paycheck Protection Flexibility Act 법안(5/27)의 주요 내용들을 채택함으로써 기존에 PPP 감면조건의 문제점들을 일부 해소하게 되었습니다. 대통령도 6/5 일자로 서명을 마쳐 최종적으로 법이 적용됩니다.
따라서 아래 변경 내용을 숙지하고 전액 면제 신청을 준비하시면 되겠습니다.
<주요 변경 내용>
1. 8주 PPP 지원금 사용기간을 24주로 연장
기존 PPP 금액 수혜자: 8주나 24주 중 하나를 선택해서 그 기간내에 지원금을 사용하고 상환 면제를 신청할 수 있습니다.
신규 PPP 신청자: 24주를 원용해야 하고 올 12/31 이후로는 그 사용기간이 연장되지 않습니다.
2. Payroll Cost 로 사용해야 하는 비율이 75%에서 60%로 감소
단, 과거 지침과 달리 이 60% 요건을 충족하지 못한 경우는 PPP 지원금 전액(일부 충족못하는 금액을 제외한 금액이 아닌) 모두 상환해야 합니다.
3. 6/30 까지 2/15 수준의 임금 및 직원수 회복 의무가 12/31 로 연장
12/31 까지 2/15 일자 수준의 임금을 지급하고 2/15일자 직원수를 재고용하는 마감일이 12/31 로 연장되어 이 기간까지 2/15 수준을 맞추면 됩니다.
단,
1. 기존 직원을 재고용하려는 노력을 했으나 그 직원을 고용할 수 없는 경우 or
2. 12/31 전까지 자격을 갖춘 직원을 찾지 못한 경우 or
3. 2/15 일자 수준으로 영업이 회복되지 않은 경우를 증명할 수 있는 때는 줄어든 임금 수준이나 직원 수에 예외를 인정해 이를 반영해서 상환면제를 할 수 있게 되었습니다. 따라서 해당 비지니스는 이를 증명하기 위해 증명 서류를 잘 준비해야 합니다.
4. 면제가 되지 못한 PPP 지원금의 상환 시기 2년에서 5년으로 연장
PPP 면제 요건을 충족하지 못한 경우는 연 1%로 5년내 상환을 하면 됩니다.
5. 지난 지침에서 금지되었던 PPP 를 받은 비지니스의 PPP 로 받은 직원의 Payroll Tax 지불연기도 가능하게 되었습니다.
이번에 통과한 PPP 상환면제 요건 완화법은 PPP 수혜자의 감사에 대해서는 규정이 없어, SBA의 지침에 따라 $2 Million 이상 받은 비지니스가 우선적으로 감사의 대상이 됩니다.

Paycheck Protection Program Flexibility Act (PPP Flexibility Act or Act) to provide businesses with greater flexibility and more time to maximize forgiveness of loans received under the Paycheck Protection Program (PPP), as enacted under the Coronavirus Aid, Relief, and Economic Security Act (as amended, supplemented or otherwise modified from time to time, including, without limitation, by the Paycheck Protection Program and Health Care Enhancement Act, applicable federal regulations and interpretive guidance issued by the SBA and Treasury, the CARES Act). The PPP Flexibility Act has been further supplemented by the (i) Joint Statement, issued on June 8, 2020 by U.S. Treasury Secretary Steven T.
