[Important] - SECURE Act실행에 따른 2020 Tax Year의 Qualified Plan Deadline 연장 및 변경사항

최근, 2020년 SECURE Act 와 관련하여 Qualified Plan 셋업의 Deadline에 대한 질문들이 많이 있어, 관련 내용을 안내해 드립니다.
- 기존 Trust Set-up의 Deadline이 Year end로 되어 있었는데, 일부 플랜의 기한이 Corporate Tax Filing Date로 변경되었습니다. Tax Extension 날짜를 포함하고 있기 때문에 2020년의 Plan의 Election을 위해서 최대 9/15/2021까지 Trust Set-up과 Funding 이 가능합니다.
- Qualified Plan가운데, Defined Benefit, Cash Balance, Profit Sharing 플랜이 위의 변경된 Deadline에 적용을 받습니다. 참고로 401(k) 플랜은 여기에 해당되지 않습니다.
- Safe Harbor 401(k)를 Election 할 경우 기존의 10/1 Deadline에 일부 변경이 있습니다. 만약, Non-elective Contributions 옵션을 Matching으로 할 경우에는 기존 10월 1일이 아닌, Year-end 로부터 30일 이전까지 Employee Notice를 주고, Plan Set-up 이 가능합니다. 즉, 11월 30일까지로 연장되었습니다.
- Safe Harbor 401(k) 를 Election 하는데, Matching Contributions 옵션을 활용할 경우에는 기존의 Deadline이 그대로 적용됩니다.
SECUREA Act로 인한 Qualified Plans들에 대한 Rule 적용이 본격적으로 2020년 Tax Year로부터 해당되기 때문에 이와 관련된 질문들이 많이 있는것 같습니다. 위와 관련된 주요 참고자료들을 보내드리며, 향후, SECURE Act 전반에서 Retirement Plan 관련 된 내용들을 정리해서 Update 해 드리도록 하겠습니다.
